General Terms & Conditions

These General Terms and Conditions of Carriage (the "Terms and Conditions") of OkeyBuz (Pvt) Ltd ("OkeyBuz") apply to all services provided by OkeyBuz.

1.         Scope of Application

1.1.      These General Terms and Conditions of Carriage (the “Terms of Carriage”) apply to the booking of journeys with and the carriage of passengers by OkeyBuz (Pvt) Ltd ("OkeyBuz") concluded on or after 1 July 2018.

2.         Contracting Party

2.1.      The Contracting Party for journey bookings (ticket seller), the use of the online portal and for the respective contract of carriage is OkeyBuz (Pvt) Ltd, a private limited company registered in Sri Lanka (registered number @@@), having its registered office at @@@.

3.         Contract of Carriage

3.1.      A contract of carriage between is concluded when a Booking is placed with OkeyBuz via the OkeyBuz website (www.okeybuz.com) and this booking is confirmed by OkeyBuz by means of an email booking confirmation (the “Ticket”) (see cl. 5).

3.2.      The contract of carriage is entered into by and between OkeyBuz and each person who is to be carried by OkeyBuz and named on Ticket (the “Passenger”). If a Ticket is purchased by a person other than the Passenger, that Ticket is purchased, and the contract of carriage concluded, on behalf of the Passenger, with the person making the booking acting as the Passenger’s agent.

3.3.      The contract(s) of carriage embodied in a Ticket entitle(s) the named Passenger(s) to a journey between the point of departure (the “Pick-up Point”) and the destination stated on the Ticket subject to and in accordance with the provisions of these Terms of Carriage. Later boarding or earlier disembarkation may only be permitted subject to prior request to OkeyBuz and at the driver’s discretion.

3.4.      A Ticket may only be used by the Passenger(s) named on it and may not be transferred to or used by anyone else, except for with OkeyBuz’ consent and subject to that other person’s acceptance of these Terms of Carriage.

3.5.      For the avoidance of doubt, no obligation of carriage arises until a Ticket has been issued and the obligations of carriage only apply as between OkeyBuz and the Passengers named on the Ticket.

3.6.      The Passenger must be at the designated Pick-up Point at the time indicated on the ticket or in any subsequent communication from OkeyBuz. The right to carriage lapses if the Passenger is not at the Pick-up Point within five (5) minutes of the vehicle’s arrival at the Pick-up Point as scheduled or otherwise communicated.

4.         Tickets, carriage charges

4.1.      The stipulated carriage charges must be paid in return for carriage. OkeyBuz issues Tickets as proof of payment of the carriage charges. The Ticket comprises the email booking confirmation, either printed out or displayed in electronic form and is valid only in combination with official photo identification.

4.2.      The first name and surname of the passenger and, if applicable, the date of birth, must be provided during the booking process. The passenger's name is matched with the booking list that is displayed on the driver’s smartphone in order to determine whether there is a claim to carriage.

4.3.      Access to the vehicle is only permitted to Passengers with a valid Ticket.

4.4.      Each Passenger holding a Ticket shall be entitled to one seat, which the Passenger may select on embarkation. Passengers with children and persons with impaired mobility are given priority in the selection of seats.

5.         Ticket sales

5.1.      The representation of products on the website and the online shop shall not constitute a legally binding offer, but a non-binding online catalogue (an invitation to treat) on the basis of which potential Passengers may choose to submit an offer to purchase a Ticket (a “Booking”).

5.2.      A Booking is made by clicking the "Book" button and making payment and constitutes a binding offer on behalf of each named Passenger to conclude a contract of carriage on the named date and between the named Pick-up Point and destination.

5.3.      The contract for carriage shall not be deemed to have been concluded until OkeyBuz has accepted the order by issuing an e-mail confirmation of the Booking (the Ticket).

5.4.      The Passenger acknowledges that data communication via the internet cannot be guaranteed in an error-free and/or permanently accessible manner and that OkeyBuz does not assume any responsibility for the constant, uninterrupted availability of its website and technical systems.

6.         Carriage charges

6.1.      The fare only covers the transport of persons and standard baggage. Any other services such as the carriage of extra or special baggage will be subject to extra charge.

7.         Payment

7.1.      OkeyBuz accepts the following methods of payment only:

(a)        PayPal

(b)        Credit card (Mastercard/Visa/Amex)

(c)        Sofort

(d)        iDeal

(e)        AliPay

7.2.      In the event of credit card purchases, the purchaser’s account is charged when the Booking is completed. By making a credit card payment, purchaser hereby instructs his or her credit institution at the time of booking to inform OkeyBuz or one of its authorized third parties of the customers' names and full addresses in the event of a chargeback, in order to permit OkeyBuz to assert its claims against the purchaser.

7.3.      The Passenger/purchaser shall be obliged to pay the banking charges incurred in the event of a chargeback associated with a credit card payment. Cancellation charges may also be incurred. Passengers shall be given the opportunity to prove that the chargeback incurred less or no costs.

7.4.      The total ticket price stated in the online shop includes any payment fees that are charged by third-party providers for the payment method chosen by you and which have to be paid by you, as well as any applicable value added tax.

7.5.      Tickets can only be changed via our customer service. Cancellation is excluded.

7.6.      The commercial use and, in particular, the resale of vouchers, is not permitted, and will be sanctioned by OkeyBuz by means of the blocking of tickets and/or the assertion of damage claims.

7.7.      The payout of any balance on a coupon shall be excluded.

7.8.      Every voucher ride is separated and detached from other rides.

7.9.      The Passenger is entitled to withdraw from the purchase contract within 14 days. Notice of withdrawal must be given in writing.
